Thank you for your input. As I said in form I-140->part 6->item 3 I have specifically mentioned using of machine learning. Moreover in my recommendation letters and my petition I have mentioned multiple times that my research is in optimization and machine learning.

Moreover, as you said to avoid any future accusations of misrepresentation I guess it would be better to clear up confusion right now.

I do not know either!!

However in Nontechnical description of the job (Form I-140->part 6->item 3) I have explained:

"Developing decision support and prediction systems to configure, manage, and optimize engineering systems using machine learning and operations research techniques."

Do you think I can use that as a proof instead of just referring to SOC code?

I will start it mid May or early June (If I receive my greencard EAD). If I do not accept it I have to stay in school and not to graduate.

Chen just said do not accept the job. This is their mistake! I told them multiple times that category 15-2000 is the best fit. However they insisted that it's better to file 17-2112 (industrial engineer). I cannot find any PhD level jobs with industrial engineer soc description. Description is for undergrad level. Moreover, the job offer is too good to decline!!

It has been mentioned multiple times in my approved I-140 petition letter that my research is in machine learning and optimization. Do you think I can use that as a reference for engagement in the same field RFE? This does not make sense that USCIS adjudicate engagement in the same field just based on a SOC code. What else can I do to show that I am engaged in the same filed if I accept the job?

I have a data scientist job offer and want to accept it. My I-140 (NIW) petition was approved on Nov 2017 and currently my 485 is transferred to NBC. I am graduating with PhD in industrial engineering and my research is in optimization, algorithm design, and machine learning. Based on V.Chen's suggestion I chose 17-2112 (industrial engineer) soc code for my I-140 petition, although I told her that 15-2000 (mathematical science) category is a better fit based on my expertise and experience. Now I asked Chen to evaluate my job offer and she is saying:

"we believe that USCIS would find that this endeavor is nationally important. However, we DO NOT believe that USCIS would find that this position is in the same field as that which is the basis for your I-140 (industrial engineering). Rather, it appears to be more related to the field of computer science. Therefore, we recommend that you DO NOT take this position."

Does anyone have similar experience or suggestions if will cause any trouble in future accepting this job offer? I have provided SOC code definition of "industrial engineer" and "data scientist" jobs below:

17-2112 Industrial Engineers
Design, develop, test, and evaluate integrated systems for managing industrial production processes, including human work factors, quality control, inventory control, logistics and material flow, cost analysis, and production coordination. Excludes “Health and Safety Engineers, Except Mining Safety Engineers and Inspectors” (17-2111).

15-2051 Data Scientists
Develop and implement a set of techniques or analytics applications to transform raw data into meaningful information using data-oriented programming languages and visualization software. Apply data mining, data modeling, natural language processing, and machine learning to extract and analyze information from large structured and unstructured datasets. Visualize, interpret, and report data findings. May create dynamic data reports. We have pictures together from 3 years ago and have the same apartment address, and same renters insurance for about 1.5 years. We also have both names in car insurance for 7 months. we can also have affidavits from friends that we were together these years. Does does evidences suffices to show bona fide marriage?

Thank you so much for your suggestion. I'm thinking of the same thing. I asked Chen and she said as long as your 485 is pending you can file hers as well. I'm thinking of having American marriage and get the certificate and file 485 for her, then in the meanwhile we can do AGHD and have parties. How does that sound?

Thanks for information mate. However, my fiancé is in US under F-1 visa (actually we go to same school). She has valid I-20 for 3 more years. Then what would be the problem if my green-card gets approved and she files after my approval? Isn't it possible?

I have recently received my NIW I-140 approval at NSC and is about to submit my I-485. I am currently single but about to get married in 4-5 months. Is it better to wait until get married and then submit I-485 together, or I file now and my wife files 4-5 months later (while my I-485 is pending)? My I-140 PD at NSC is 12/27/2016 and not news so far! We have seen lots of approvals even from late January. That's why I'm getting worried of why it is taking so so long.

1. Is there anyone around my PD that still waiting?

2. For those of you who got results so late compared to others, can you please share the office ID? Mine might be with same slow motioned officer as yours was.

It is scary. Although, TBH other categories are also being slowed down. There were only 6 approvals on VC site this week so far and the latest one was approved on Jan 12. I suspect it is a culmination of the criteria change and "Trump effect" that has all but stopped NIW cases.



I guess there is no NIW approval after 12/23/2016. Also, approved cases in VC website are all for September 2016. They have posted it recently because they do not post until they receive formal notice. All fingers and toes crossed!

My attorney mailed my package on 12/22 and USPS received notices was 12/24. USCIS received date was 12/27 and I do not have any problem so far. I paid 580$ for processing fees.
