Topic: Immigration Came to my Client Work Place

this happened to a friend of mine too, USCIS officer visited his office. he was in a meeting at the time he was called out of the meeting, asked a few questions on his role, pay, reporting, experience, qualifications, etc. He was asked to email a bunch of documents to USCIS post the visit... this was around 6-8 months back, everything fine since then..

Hello Every one, Just need some info...I received my H4 approval notice to my mailing address a week back with approval date of Aug 23, 2017. I am yet to receive the H1 approval notice from employer. I checked with them, they are saying they are yet to get it. Its been 2 weeks now.

If H4 is approved means, H1 should have also been approved right? Unfortunately the status on the uscis site is not reflecting for both H1 and H4.

Please let me know how long it usually takes for h1 in this case or any one experienced this type of case?



same here, i got the H4 approval notice yesterday with approval date - 8/24... no update on my H1 yet..

I agree if we consider US citizens in this mix. Other than educational cost, do you think this expensive health care system,raising asset prices in India/US and greencard backlogs are limiting Indians to have 1 kid??.I am seeing a lot of single kid families in India.



absolutely! most of my older cousins back in India stopped with just one kid.. guess the whole dynamic is changing.. rising education cost in India, real estate going up, women becoming more career focused, small nuclear families in urban areas, etc.. anyway, we are way off topic :)

I guess it is safe to say that this is inclusive of US citizens as well as other immigrants.. i have very rarely seen people having just 1 kid here...

It is better to return back to US before applying for H1B transfer. If the employee willing to work for the new company based on H1B transfer receipt then you need to wait for the approval to return back to US and may require stamping.



i think you are mistaken, as long as she has a valid H4 stamp and her husbands I94 is valid, she can enter the US.. recently a friend of mine did the same.. she traveled here on H4 when her husband had changed jobs on H1 while she was in India..

Decision to have one or two kids varies by individuals. I have seen even well to do families limiting to one kid and single earner families with two kids. Personally, I had 2 sisters and one brother, large family. Typical middle class in India and enjoyed our childhood and even college days within limited means. Most struggle I witnessed was during college and after college when I was in marriage market. We had few good looking chicks in engineering college but they were grabbed with those having money or had only one sibling or were only ones to share their parents wealth. Also during arranged marriage girl search, many parents will not contact after learning my parents had only one flat and 4 kids. It may impact one's decision to limit kids. But again it's individual choice. Sharad Pawar has so much wealth but only one daughter.

If you have only one kid, it can feel lonely in US. But he may be more fortunate during college education and subsequent years as you can easily fund his education and not make him struggle. If you plan to raise your kid in US, I would advice to have two kids if you can afford their college education. I went back to India for few years deliberately so that my son could get exposure there and enjoy time with siblings(cousins, relatives). Every decision you make has pros and cons.




We decided as well to have only one kid, he is 5.5 now.. but sometimes we do feel that maybe we should have had one more.. but now feels that we are too late.. anyway, the reasoning was the same.. have one kid and provide him/her the best you can in terms of private school education, help with college education, sports, etc... but i see very rarely people in US having 1 kid.. everyone has atleast 2...

Hello folks,

My H1B Transfer petition has reached Vermont center on May 31st. (Future employer provided with FedEx tracking number).

Can someone please guide me on the expected time to receive the receipt number ? And also is it a good idea to go ahead and join the new firm with just receipt number? My visa is stamped till August 2017, current employer is filling an extension as well.

hey, mine was also H1b transfer filed at vermont on 15th May got the receipt # on 25th May.. Today i joined my new employer based on receipt #

First they are lying to you by saying that H1b petition is the property of the employer... they need to share receipt copy and approval copy and the entire petition bundle with you ..looks like you are already stuck with them..so good luck!

Tell them politely but be firm, include both attorney and employer contacts in email and ask them you need it for tracking purposes and you would need the copy of receipt notice (number to begin with) as a minimum before you can join the employer



I tried that, they just wont share, saying H1b petition is the property of the petitioning employer.. and i am already working here as a contractor.. so i dont have the leverage of saying i wont join without it...

I thought the same..!! the attorneys are from a law firm who are managing the immigration for my new employer... she told me its the company policy to not share the receipt #

New employer is Barclays btw...

It could take 8-10 months to know whether the new H1B transfer will go through smoothly or not - I'm fairly certain my current employer will not keep my H1B active for that long, so I don't have the liberty to wait for the actual approval before deciding to join the new company. Usually, my current employer doesn't revoke H1B as soon as employee resigns, but it's definitely done within the month. I'm located in NY so my case will go to Vermont Processing Center which is taking the longest time to send the receipt. I guess I have no choice but to wait.



what date was ur h1 transfer filed? Mine was 5/15, I am in NY as well so must have gone to Vermont

I'm currently employed at Company A and recently signed an offer with Company B. Company B has filed my LCA and is going to file my H1B transfer as soon as the certified LCA is back - hopefully this week. The new company deems it OK to start working with them once they get the FedEx receipt of the H1B package from USCIS, which I know many people do, and is quite common. My question is - What can go wrong between getting the FedEx receipt and the official USCIS receipt? I understand USCIS could find some documents missing (incorrect check amount, missing signature, missing document etc.), and reject the H1B transfer request and ask to refile. In this situation, if I've already quit Employer A and started working for Employer B, what is my status? Am I legally allowed to be in the country and work? Given it's taking a long time to get the official receipt from USCIS, I'm trying to weigh my options based on the risk. Further, I've also read that lawyers can get the receipt number from the back of the check cashed by USCIS - Can anyone advise how long this typically takes once H1B transfer is initiated? I'd ideally like to wait to give notice to my current employer at least till get the receipt number, if not official receipt, but would appreciate any advise based on your experience.



I have done exactly this in the past... the receipt # was not generated and i joined based on fedex acknowledgement. the lawyer had sent me an email saying it is absolutely fine to do so. This was 2 years ago, i am now again in the same boat but now the new employer wants to wait till the receipt # is generated, h1b transfer filed on 5.15 waiting for receipt #
i would say that check with company B lawyer about what all can go wrong, get it in writing, have all the options in front of you and then take a call.. All the best!

Topic: EB2 - H4 Child Aging out


My priority date is February 2015. EB2 from India. My H4 son will be 6 years old this year. so we have further 15 years till he ages out as my dependent on my green card application.

The child protection acts does not help much as my I-140 was approved in premium processing in 13 days. so we will get additional 13 days after my son turns 21.

This situation scares me. I have half a mind to go back to India now when my son is young enough. or move to Canada.

Am I thinking too much at this early stage? Comments welcome.

You mean to say 80% is Gross not Net/Take Home.



Take home is 80... i know the rate, coz i negotiated with the client HR.. client HR only recommended this desi consultancy to transfer my visa.. i had the found the opportunity myself...
