Totally agree with you. However, a good PhD, can easily provide several evidences that meet plain language criteria for EB1B and more (and that's a good start in my opinion).

I don't know how true it is, but USCIS has come to expect PhD from EB1B applications. Anything minimum and you will have to really prove yourself. Also, they don't really give any weight to your current work with big tech employer unless you can prove it has impact on the field and is internationally recognized (kind of hard for industry work due to IP concern and all).

secondary citation is counting citations of papers that were majorly inspired by yours. This is used by lawfirms all the time but you do have to show your work was rockbed of paper/s that cited you (and hence their citation works as secondary)

This HR392 thread should go away. Come on guys: we are not sure if H1B extension would survive and we are discussing HR392. Have we really lost our senses?
