Topic: H1B Extension

Premium and non-premium processing makes no difference on final outcome. Personally I prefer premium as it reduces anxiety and also USCIS has become painfully slow so any delay on your part in filling H1B extn may result in a situation where you are not eligible to work and you may need to leave country.

Topic: IV call this Sunday, any predictions?

America has to move towards merit based immigration without country cap.

Unchecked specially family based immigration is not sustainable specially when America is breeding ground for automation. This ROW vs India debate is meaningless. America needs smarter immigrants who can sustain tech based economy. Indians are just lucky that current EB system can be more favorable towards Indians but it can change. Nothing stays same forever.

I see HR392 happening sooner than later. it will happen only because time for HR392 has come.

Topic: H1B Stamping question in Toronto

Even i went to Montreal for visa stamping. Montreal consulate is small but my visa stamping went like a breeze.
I did my interview on Monday and i got my passport on Thursday.

I was once told by immigration lawyer that when it comes to immigration assume murphy law and plan according to that so anybody who feels the same way should go to home country.

I went to Canada because my company was sending me to Japan and i didn't want to miss that trip and also i wanted to take trip to Montreal.

Do whatever rocks your boat.

Topic: H1B Cruise to Mexico

sorry if i offended you but i am also desi and i know that generally desi ppl like to pretend to know everything and that is a problem.

Now i work on other side and regularly hire desi consultant/consulting companies for projects. Regularly my user tell me that i know that this consultant gave me wrong info and i am not sure why they just don't tell me that they will get back to me or they don't know.

Topic: H1B Cruise to Mexico

Amazing how desi people pass wrong information instead of saying i don't know.

I have posted this in multiple forum. This is true for cruise ships starting from US and ending in US.

When you are boarding on ship, CBP only checks your lawful presence in US. Nothing else. It is similar to DMV office where they check your legal status and provide you DL. Visa stamped in passport is good to have but not required.

When you go on cruise, there is no exit/entry stamp on your passport. It also doesn't go on your I-94.
I did the cruise and i had the exit entry on my I94 but no entry so i visited local SSN officer. That exit entry was removed and SSN office people told me the rule and told me that you are smart to check your I94 after travels.

I will suggest everybody to always check I-94 after completing any travel.

When you make port call, you don't need any visa to enter in that country. Everything is managed by cruise companies. You just need to show your cruise ship room key.

If you are going to Mexico, Mexico official policy is people legally residing in US can visit Mexico for 7 days without visa.

Dude, how your resume is going to justify your new job. If desi consulting is hiring you for the role and ready to tweak your resume for H1B then you are on a very slippery path.

Puerto Rico is US territory. If you can take a flight to Vegas then you can go to Puerto Rico.

Topic: Post H1B Amendment denial status question

Go for the promotion. Just make sure your new job description is well written and requires high skills.

I know lot of ppl on H1B working as product manager/director in product companies. Companies say that their product is very technical and only high skilled person can understand and market it,

Topic: 401(K) Contribution?

that's why best thing is to take loan against your 401k savings. bank knows that there is money so very less risk.
401k is like an asset.

Topic: RHC to IV - Open Challenge

Totally agree with this post!

Join a group where you are going to be active otherwise no point only paying money and hoping that somebody else will get your job done.

Not sure why IV and RHC are fighting with each other. You both want same thing so join hands and work for immigrant community stuck in long GC wait.

Few things:
1) IV should not get defensive when talking about HR392 and related impact to Indians. In one of his speech, Kevin Yoder openly said that Indians are most hit by country cap and everybody knows it. No need to get around this point.

2) Both group should openly tell us that how they are going to pass HR392. IV boast about having so many co-sponsorship which we know means nothing as there are so many ifs and buts. RHC flaunts their relationship with POTUS but we don't how they are going to convince him to help RHC to pass the bill.

3) I feel RHC is doing correct thing to push plight of legal dreamers. Economic migrants are always low priority as they are only looking for good life and there is no humanitarian angle or urgent need. HR392 has strong chances when we will use H1-Dependent kids who can loose status due to country-cap related GC delays for people from India. IV should not be against this tactic.

In the end, legal immigrants can get benefit only under Republic administration. Forget any help from Democrats for legal immigrants. It is known that Democrats don't want to do any legal immigration till they can help undocumented immigrants.

RHC and IV should join hand to get HR392 passed in current senate/congress.

Topic: 401(K) Contribution?

If your employer fully matches certain percent of your annual salary then you should certainly contribute in 401k/403b. I have seen matches from 3% to 7%. Employer match is a free money and long term index return is always greater then 5%.

I know withdrawing at 60 sounds too long but we will get there one day.

If you urgently need money then lots of bank give zero percent loan against your 401k/403b.

Topic: AVR & Cruise from FL

Did 7 days cruise and visited Bahamas/Cayman Islands/Jamaica/Mexico.

When your boarding on cruise ship, CBP officer only make sure you are legally in US like they do at DMV office. They don't look for stamped visa in passport. Also there is no exit/entry in your I-94 history.

Nobody checks passport or any travel documents when you make port visits. Only thing is cruise shud start and end in US.

Topic: Urgent — friends seeking your help regarding denail

Guys, unless it is urgent don't join new employer based on H1B receipt. Pay for premium processing from your pocket to have approval before you join new employer.

H1B scrutiny is going to increase more and more. I saw lot of tweets from USCIS asking to report H1B abuses and lot of disgruntled desis tell USCIS about loopholes used by Desis.

Topic: RHC MEGA Rally in DC - April 15

As of now RHC has more political capital then IV. IV main spokesperson is some Obama era bureaucrat. RHC used Rand Paul. Big difference.

IV is going all out to discredit RHC because they do feel threatened.

Don't feel shame when a party is representing religious minority aka Hindus in America. There are tons of group to help other minorities such as Latinos and Muslims and they don't feel bad about it.

Go to D.C. and make this rally a success. For us HR 392 matters not who gets the credit.

Rand Paul is touching HR392 due to RHC. Also the way IV and RHC are fighting, looks like there is light at the end of tunnel.

USCIS can provide you protected status if you can be a legit whistleblower. Use a lawyer to know how strong is your case and talk to USCIS for a good deal.

dude, when women march happened lot of men also participated cause those men believed in the cause which was related to women.

No matter which group is organizing the event, you join to promote the cause.

Also if HR392 happens, it will happen for all.

Are you waiting for an angel who will come down from heaven and clear GC backlog.

Leave it or take it but RHC can be biggest advocate of desi stuck in backlog if we show up in huge numbers in DC for RHC rally.

Topic: IV vs RHC - Who is really trying to help us ?

I will bet on RHC.

IV’s biggest asset is Leon and RHC begin with a Senator. Huge difference.
Looks like Aman Kapoor wanted to join Dems later hence he uses term bi-partisan all the time.

You can be partisan and get things done as you begin with support of a party.

Topic: Immigration Reform is coming soon

In current world it is foolish to assume selfless service. I am just suggesting that people should go to DC. If nothing else, huge gathering will bring our issue in open and may be give RHC political capital which they will use to become insider. Remember, after getting GC and citizenship you will become voters.
