Hello everyone,

My labor was approved on Jan10 2017 and my employer is ready to file I140 in regular but not premium. I have requested I140 in premium processing as I would like to try out H4EAD before it goes away for my spouse. I thought premium processing would let me be in the timeframe before they remove H4EAD.

My employer is refusing premium processing since per their experience they saw RFEs for 90% of premium cases and which would affect all employees at the company. As I140 RFEs would seek questions about the company and wages of all other employees, they made it as a company policy. I do not understand why they are speculating about RFE? Is it that hard for a company to provide all documentation?

Please suggest if regular processing can be an advantage to my situation of H4EAD for my spouse?
