Problem is that, I filled I-140 and I-485 concurrently. And I already received my finger print appointment schedule.
If I withdraw my I-140, that can trigger denial of my I-485 as well

But the notice USCIS specifically mentioned what document they are looking for. these are the 2 documents they wanted from my employer -

1. Evidence to show that the minimum requirements of Form ETA 9089 are an advanced degree or the equivalent of an advanced degree, that is, a baccalaureate degree or five years of progressive experience in the specialty.

2. Evidence that the beneficiary has an advanced degree or has the equivalent of an advanced degree(a baccalaureate degree and five years of progressive experience in the specialty).

Then how can we give something different? Not sure how to explain them. Are they are going to accept it or not.

My I-140 status show this below message -

"Read the notice we mailed you for details and instructions on how to respond to our request
You must respond with your documents by the due date listed in thenotice.
If you do not respond, we may deny your case."

My employer made a mistake that in my I-140. He selected EB-2(advanced Skill) category, which it should be EB-3(Skilled Experience) category. In the notice Fax, it clearly mentioned that my employer made this mistake.
My employer is telling to withdraw the case and resubmit it again, when USCIS is telling clearly that they need an answer and seems like they will accept the explanation. What should I do now. Please suggest.

status said, my file has been reviewed and will be certified.

Did you got your approval? I haven't got mine yet.
I can see around 15 files got approval past 7 days from May,17. Maximum are IT related and 3 are from CA.
Still 52 files left with 'Final Review' status and only 5 of them are IT related. I guess if you haven't got your approval yet, then we both are in this 5 unlucky persons list.

Here are the state wise record, those are still in final review.
5 -> CA [3 IT related]
1 -> DE
13 -> GA
7 -> NE
2 -> NJ
1 -> SC
2 -> TX [ 2 IT related]
3 -> VA
1 -> WA
16 -> WI

Thanks for the update. But according to May perm file cases record that I have, I can see there are 52 'Final Review' files are left, including mine..... !!!

And 94(Final Review) files are left from Jan 2017 to May 2017.

One more thing, probably they are clearing files based on State now.
Last 30 days they cleared all the North Carolina's file. Only one file left in NC now and NC had the most files of 'In Process' according to my file analysis. Which state they are going to grab next, not sure. Probably next would be 'GA' or 'WI', because they have the most files still in process.

There are still 67 files remaining in May 2017 on 'Final Review'.

Topic: Wrong Education degree name

Hello everyone, my employer made a mistake at the time of adding my education degree name field.
So the degree name is fine, but in second portion they putted wrong evaluated degree name because of shortage of space.

Here is the degree name they putted in my labor file -
"COMPUTER SCIENCE AND ENGINEERING [EQUATES TO A USBACHELOR'SINCOMPUTERSCIENCE AND ENGINEERING]"
It should be -
"COMPUTER SCIENCE AND ENGINEERING [EQUATES TO A US BACHELOR'S IN COMPUTER SCIENCE AND ENGINEERING]"


Second mistake they made, in the evaluation report it said my education is evaluated to U.S. 'Bachelor of Science Degree in Computer Engineering'. But my employer putted 'Equates to US bachelor of computer Science & Eng.'
Is that 2 different meaning OR same?

My employer sent an email to helpdesk and received reply from helpdesk about my file status about one month ago.
My file status is still in review, PD May 08.
How soon my employer/lawyer can send 2nd query email to helpdesk?
Is there any timeline?

Is that can trigger an audit or denial?

I would appreciate if anyone has any idea on this and suggest me.
In my perm labor file my lawyer putted my education as
COMPUTER SCIENCE AND ENGINEERING [EQUATES TO AUSBACHELOR'SINCOMPUTERSCIENCE AND ENGINEERING]

because there was no space. But according to the evaluation report it should be
COMPUTER SCIENCE AND ENGINEERING [EQUATES TO A US BACHELOR Of SCIENCE DEGREE IN COMPUTER ENGINEERING]

Is that gonna be an issue? My labor file still in process, passed 275 days with no audit.

Or I am the only person waiting for certified my perm labor from May. Have not received any audit yet. Still on process. Checked last quarter disclosure data.

Here are the steps to get the Disclosure data -
1. Go to this website: https://www.foreignlaborcert.doleta.gov/performa...
2. Select 'Disclosure Data' tab.
3. In the latest quarterly update table, Download the disclosure file -> 'PERM_FY2018.xlsx'.

Well my employer received an email back from labor department after sending an email to helpdesk after 4 working days. They said, my file is still in process. I checked the disclosure data till December 2017 and status is displaying 'Final Review'; which means 'In process'.

Did you check the last quarter disclosure data?
I am also EB3 category. My employer also filed other 2 files with EB3 category and they got their approval within 3 months of submission. Also except my file, my employer got all the other files approval (8/9) within 5 months from PD date.

I think your lawyer is tell you lie. Check the disclosure data if you haven't checked yet.
