Topic: Premium processing receipt delay

Hi All... there’s another way of checking the receipt number. In case your attorney/employer doesn’t receive the receipt number in email or receipt notice, they can check whether the check has been encashed through their bank. Usually, when USCIS cash the check, it’s mandatory for them to put the new Receipt number of the petitioner and have the scan copy of encashed check uploaded. Only attorneys and employer can access the bank account to see the cleared check.

I got to know about this info from my attorney when there was no email received/receipt notice received from USCIS despite putting the case in Premium processing.

Hope this helps you guys!!!

Topic: Government shutdown and H-1B

That’s correct. DoL operation will be halted until this shutdown is lifted so will affect LCA and prevailing Wage determination process.

USCIS and Department of State will continue to work but expect some more delay in responses in H1B/I-140 decision.

Topic: H1B Stamping and Dropbox timeline at New Delhi

Sorry to hear that. Though, my drop-box location is Hyderabad but I believe nowadays, most of the people (if not all) are getting this status 'Administrative Processing' no matter whether you're going for Drop-box or appearing for Consular Processing. Please keep patience and if possible, send an email to New Delhi Consulate so that you'll get a clear picture. ND Consulate are very prompt on responding to applicant's query.

All the best. Hopefully, it will be approved and you will receive passport with visa stamped before Jan 25th.

Topic: Timeline for passport receipt for dropbox

Mine was H1B Transfer.
Background -
* Changed the employer back in March -2017
* H1B transfer initiated in Premium Processing
* Got 1st RFE; responded in 2 months
* Got 2nd RFE; responded in 2-2.5 months
* Got Denial Notice because of Level Wage 1 in Oct-2017
* Left USA and came back to India since I-94 was already expired and don't want to overstay over there.
* Submitted 2nd I-129 petition with new Level Wage 2 in Dec-2017
* Got approval and went for Drop-box in Jan-2018 and rest is mentioned above after that.

Visa Interview Questions during Consular Processing
******************************************
1. Who’s your petitioner/employer?
2. For how long you’re working for this employer? And before that? Name of the previous employer?
3. Can I see your I-797?
4. How many people are employed at your current employer?
5. Who’s the client? What they do? Can you pass on your client letter?
6. Please elaborate on what they do?
7. Will you be working at client location? Where exactly?
8. How many people from your employer would be working at client location?
9. Is your client a large company? Less than 1000?
10. What will be your salary?
11. So, your employer filed for your visa transfer petition in March 2017. What happened to that?
12. Did your employer told you the reason for denial?
13. What have they done to get this approval?
14. Can you tell me when you did you receive denial notice?
15. When did you came back to India?
16. What were you doing after coming back to India?
17. Where were you working from March till October? Asked about previous client.
18. Location
19. Why can't you work for previous client again?
20. Have you worked for your current client before?

Then Consular Officer said - Congratulations. Your visa has been approved.

Sorry for a long story but wanted to share my experience so that other can be benefited from that.

All the best guys!!!

*************************************************************
New Delhi Consulate –
Greetings from New Delhi!
Your application is refused under Section 221(g) of the Immigration and Nationality Act for administrative processing. After administrative processing is complete, the application will be reconsidered. U.S. immigration law requires that additional steps be completed in some cases before a file can be advanced for adjudicative review.
The Department of State is continuously working to expedite visas. Please be assured that we will contact you as soon as your case is processed to conclusion. You can also check the status of your visa online at: https://ceac.state.gov/CEAC/.
Thanks and regards,
Consular Information Unit
U.S. Embassy, New Delhi
*************************************************************
Hyderabad CEAC –
Dear Applicant:
We would like to inform you that your case is under administrative processing. This processing is mandatory and cannot be expedited. While we understand your concern and probable frustration, we cannot speed things up. As soon as the administrative processing is completed, we will notify you.
You can check the status of your case by visiting our website at https://ceac.state.gov/CEACStatTracker/... and type in your case number. The website is updated regularly to reflect the most recent status of your case.
We are required to conduct administrative processing in many cases. Unfortunately, we cannot give a specific time frame during which processing will be completed, as each case is different and may require different processing than another case that may appear similar. While we recognize how frustrating these delays can be for applicants, please be assured we process each case as quickly as possible.
Most cases in administrative processing are resolved within 60 days of your visa interview. When additional administrative processing is required, the length of processing time will vary based on the circumstances of each case.
Before inquiring about your visa status, you must wait at least 60 days from the date of your interview or the submission of supplemental documents, whichever is later. Processing time will vary based on the circumstances of each case.
Sincerely,
Consular Analysis and Liaison Unit
U.S. Consulate General
Hyderabad, India

There was no 221g slip issued during my document submission or after interview process to me. Since it's only 1 day gone, I'm still waiting for positive news. Hoping to get the passport with visa stamped in coming days!

Topic: H1B visa stamping vs Dropbox

As far as I know there's no provision to choose between dropbox and consular processing (visa interview) while scheduling the interview (even I tried that one). It will be based on 7-8 questions for checking the eligibility for Interview waiver (Dropbox) which will decide whether you are eligible or not.

So I would suggest to go for Dropbox first and in next 4-5 days, you will receive an email from consulate that you will need to appear for fingerprinting and visa interview process if they feels your case needs further review. If you're lucky and there's no need for interview process, you might get your passport with visa stamped in 4-5 business days and will avoid unnecessary trouble of facing interview process.

All the best!!!

Topic: H1B Drop box @hyderabad

That's true. At Hyderabad consulate, you will need to take old petition copy (at least the last petition copy which had visa stamped) and the new one. If there was multiple employer job/petition in between visa stamped and new one then you have to take all the petition copy.

For photos, please follow the instruction.... 70% face with 30% body in 2x2 size photos otherwise you will have to get another one. There's a shop just next to VAC in Hyderabad who takes Rs. 200 for 4 photographs but he is aware of the size and requirement of visa photos. Just in case, your photos are per specification, then you can get it at that shop.

Rest of the document as you mentioned would be sufficient but keep all the other documents handy just in case they want to see. I guess you don't want to visit VAC multiple times for the same thing. :)

Since you will be going with spouse and kid, I would recommend you to reach early so that you don't have to wait for long.

The same shopkeeper takes around Rs. 50 for keeping the bag and the car parking is available at some cost.

All the best for visa stamping!!!

Congratulations!

I guess you will have to wait for hard copy of PERM certification. Then only, you can move forward with I-140 in Premium processing and then H1B in Premium.

Per my understanding, we can't file I-140 and H1B extension (even in Premium) simultaneously. Please correct me if I'm wrong.

I'm also in same boat and currently waiting for hard copy of PERM. Maxout date (with recapture) - Feb 19th, 2018.
