I have waited for more than a year ever since Obama announced executive action on EAD for H4 and for H1. H4 got it but H1 is still pending.

I have given up on the wait and do not want to compromise on my job opportunity... Accepted a new offer and joining another employer soon.

Topic: Chennai visa stamping experience.

Attended for visa stamping at Chennai Consulate general for my 8th to 10th year of my H1b...

No documents were asked.. I guess they do their homework very well.
Only documents asked was the passport.
Questions
1. Name of the company
2. How long have you been working at this company
3. Place of work.

done.
Passport arrived in 2 days.

No passport photo was required to submit they take the photo during OFC visit.. so dress well for that. I made the mistake of wear a old t-shirt, now that is on my visa.

Make sure your DS-160 is correct.. The given name, surname should match *exactly* as in the passport otherwise there is a nexus between the auto drivers and a cybercafe who only correct the DS-160 and they charge anything between 50 to 100rs depending on the correction for each DS160 + auto charge for 50rs.

I forgot to take the DS-160, the fu*kers charged me 150rs but worth the hassle.

ps: Chennai is freaking hot.

Assuming that EAD for - I 140 get approved in the coming months!

I have approved I-140 with Nov 2011 priority dates in the EB3 category, If I get the EAD based on the above law and would like to upgrade to EB2 category do I need to file another PERM and port the priority date? Or I will have to wait another 15 years to get the green card?

Can someone shed some light on this scenario? I believe lots of guys will have this question in mind!

Most likely you will have to file a new PERM for EB2, otherwise what stops me from getting my GC as EB1?

One quick Q. I am sure this has been discussed several times before; still repeating since it's hard to fish out the info.

Once the principal H1-b holder gets the I-140 EAD, does the spouse also automatically qualify for obtaining an EAD? I am asking this only because of the lawsuit against H4-EAD. If in some worst case the H4-EAD is revoked, I am wondering if there will be hope for H4 people to get EAD once the H1-b holder gets the I-140 EAD.



AFAIK So far nothing like that is talked about , but we will have to wait for guidelines from USCIS sometime in Sep-Oct (estimated timeline) also, why do you think that people will not file lawsuit against h1-ead as well?

Is it lawful to maintain two different EAD's together ( H4-EAD and I-140/AOS EAD).

After getting I-140/AOS EAD, would prefer to continue status on Non-Immigrant status on H1/H4, so can file AOS within USA without consular processing. But If some circumstances arrives, than will give-up H1/H4 status and switch to I-140/AOS EAD.

What if I apply for H4-EAD and later I-140EAD/AOS-EAD



It is not a AOS-EAD... it is a pre-register... I am not clear how different it is but it is not going to be AOS kinda benefits.

I-140 EAD or AOS reform will make spouse eligible for EAD as well.



That seems to be an assumption, if that is the case then gov had no reason to think and enact H4-EAD since the requirement for H4-EAD is for people with SO with 140 approved, etc etc.

Its all confusing, whether to apply for H4-EAD or Not, because early next year I-140-EAD is expected.

On travel H4-EAD requires visa stamping, while I-140-EAD will come with AP for travel.

Why apply for H4-EAD for 6-months, and why not wait for I-140 EAD, especially when H4 were Homemaker for 6-10-12 years.



Why do you assume that 140-EAD will yield H4-EAD? They are separate problems. Also, I would rather travel with visa than using AP, I read an article that admission with AP is more problematic than visa...

i believe it not entirely true, I believe you can continue your H1B status with an active labor.



I think the AC21 applies to Perm under process and pending for more than 365 days (there are other cases but PERM needs to be pending). Also, if I am not wrong, the 140 needs to be applied within certain days of perm approval otherwise it expires.

anyway, there are so many ifs and buts with this AC21

I know it might be too early.
I recently shifted job because of employer torture, and I have a 140 approved, almost 2 and half years back.
shifted job in December, almost 6 months passes, employer hasn't revoked the I140 and it's currently in active status.
Another PERM needs to be started with new employer and it's just started, will take a long time to get all the ground work done and apply for it. just wondering what are my chances with old 140 by the time the rule publishes in October, Couple of cases like,

if the I140 was still in approved, and employer didn't give any revocation for OCT2015.
if the I140 was revoked in between before OCT2015.
Gurus please clarify



So far there is no clarity on which I140 can be used i.e. can previous approved 140 be used .... we will have to wait when the clarification is out... which I have read that it would be around sep-oct this year.

You will not be out of status while the petition is in the process... if the COS is denied and your PERM/140 is not approved by that time, then you will be out of status. But if your spouse is on H1, then your h4 will not be denied that easily.

On a serious note what does withdrawn means?



it means that the employer does not want to pursue the PERM application to a decision for various reasons... like the perm went to audit/SR and they want to file a new perm. Employer left the company before a decision could be made, etc.
