After waiting for 238 days my AP card finally got approved. NSC forgot notifying me that my AP application is approved, but instead they sent me a notification this afternoon that a new card was mailed to my address. My OPT EAD expires on 1/31/18 so I was worried that my AP card won't be here in time, so I filed H-1B with PP on 1/2/18. It was approved last week. In retrospect, I should not have filed PP so that I can save my PI's money. Well, who would have known my AP would arrive in time?

I am just letting you guys know that AP approval could currently take up to 240 days.

I also believe you have a slim chance of getting OPT extension. As you know F-1 is a single intent NIV, by filing I-485, you are showing your intention to settle down here. This is why attorneys recommend filing OPT first before going through AOS.

I am just speechless. Basically if people like choicek can get denied, nobody woulld be safe. Given that my case is soon to be adjudicated, this makes me really nervous! Maybe that “1000 citations” officer is now adjudicating NIW!

Looks like attorneys have some sort of community forum where they can discuss current immigration trends. Otherwise, how can choicek's attorney knows denial cases from a single officer? My gut feeling tells me that V Chen is also aware of recent denial cases from the officer ex0011.

Weird. Is crosschecking crucial information like that one of the attorney's main responsibilities? To my limited knowledge, this appears rather a simple error for the USCIS officer to pick up. If they did, they should have already sent the RFE based on that. I hope you hear something soon from NSC.

I like your analogy of GC and the approved I-485. But what if you need a hard proof that you are a legal permanent resident? You must wait until the physical GC arrives at your doorstep right? You may be able to use your I-485 approval notice, but you never know whether that is sufficient. Some may take, some may not.

The official diploma may be symbolic, but the degree certificate is not. In my institute, I can get the provisional certificate saying all the PhD requirements are met after you submit your thesis (Jan in my case), but you only get the official degree certificate after graduation (May). I convinced V Chen so hard to accept the provisional PhD certificate as a degree proof, but she counter-convinced me to wait until the official degree certificate is available.

Thank you for sharing info with us.

I filed my I-140 in the late May 2017. I could've filed it in January right after my defense, but everyone suggested me to wait until the official PhD diploma is issued to me in May. I feel having a PhD does make an unignorable impact on the adjudicating process. Not becuase PhD in NIW category is something unique to only a few applicants, but it is rather because it's so common. For those who don't have, even though the application is perfectly up to the NIW requirements, it may not look that appealing compared to others. I was convinced by these arguments and decided to delay the filing by ~5 months.

My colleague who got the GC through EB-1 (with 1400+ citations) said following:
"How would you prefer to be referred in the petition letter, Mr. xxx or Dr. xxx?"

Anyway, I sincerely hope that you get through this unfortunate incidence.

Can't believe your attorney is V Chen and you still have to go through all this. I have seen cases of NOID and V Chen fixed the problem. So just hang in there! Please let us know what the nature of NOID when receiving the letter.

Should I expect the approval text/email (e.g. for AP cards, I-140 approval etc.) beginning of the day (i.e. early in the morning) or can I can expect them to be sent any time throughout the day?

Haha when my waiting time was around 180~ days, I had at least hope and expectations. Now, I am actually curious as I want to see how long it is going to take!

And yes you are right, many people who filed after us already got the AP card. Why not us? Only Gods who reside in the NSC temple know...

Wow, more approved cases! The more I see these recently approved cases, the more I am convinced that NSC is approaching ~9 months of average processing time. It is a matter of time!

BTW, my AP card is still pending approval. Now it is pending for ~230 days. Because of this, I am giving up on the opportunity to attend an international conference to be held in Cancun(!). Sigh..

This particular news regarding the suspension of H1b extension after 6th years based on pending I-140 has been circulating quite a while. I myself have been discussing with multiple colleagues of mine at the lab. The reason this potential termination is not a popular topic in this thread is that folks from ROW are not really concerned about it. In other words, there is basically nothing to talk about it. Nobody will wait for more than 6 years to get a green card unless you are from India or mainland China. And this is one of few threads in Trackitt in which majority of contributing folks are from ROW.

I noticed that outside of this thread within the I-140 Discussion Forum, there are multiple threads discussing the potential consequence of the implementation of this new regulation. You may want to visit one of those. Those are threads I get info about the current topic.

I am glad we will be seeing May cases soon!

In the meantime, I am still waiting for my combo card to be approved it is now passing 210 days. I am actually enjoying this situation as I am curious about how long USCIS will be taking to approve my combo card. Thank god I filed H1B.

To be honest, #9393 should be what processing time is supposed to be (~5 months). I guess we have become too comfortable with NSC nonsense.
