I attended the call and here is the gist:

1. These guys have no strategy and no clue about the legislative process. Should be obvious since they've been trying to get this bill passed for the last 10 years. Last year it was lets get the house majority and then we will get it passed --> lets get 2/3rd house majority --> we will include it with the must pass bill --> we will include it with the daca bill --> this will pass as a standalone bill because it has 2/3rd majority-->Lets have advocacy event and get more women because women helps 3 times as much as men to pass the bill. RIDICULOUS!!

2.Leon is a sleaze ball and I highly doubt he is capable of getting anything done. He talks about $1000 fees and be ready to pay that for the green card. Typical marketing bulls..t to distract from the original problem. How the f..k will you introduce that bill.

3. No word about H1B extension fiasco even though they claimed credit for it on their FB page. Just shows these are bunch of frauds.

What a pathetic bunch are these IV folks. I fell for their lies too. We should thank Incore but also Skandia. He was the first one who said that an investigation may be launched about this whole thing. These IV clowns probably figured that this is not India and they can be prosecuted if they are indicted of any wrongdoing. I do think anyone who has donated to them should file a complaint.

There is no way that USCIS will inform these bunch of losers about anything without making it official. That McClatchy reporter is planting all these stories.

Thats a funny comment and I really don't believe it. Had it been true, the American companies would be fighting tooth and nail about HR392 and would be desperate to convert the H1Bs to green cards. But none of this has happened. The reason is simple. H1Bs are mostly used as a cheap ,slave labor to displace Americans. If they let go all the H1Bs, its matter of time before those jobs will be replaced by automation. Same with the illegal labor. Unless you got comfortable with that fact, you will never reconcile the truth with reality.

Americans are not lazy but they don't accept slave like conditions that most H1B are willing to accept. Don't believe the bullshit that most of the companies in the valley are started by immigrants. Look around the whole world, who is disrupting the way of life. Americans.

I think you are underestimating the power of the executive over immigration matters. I'm not even talking about japanese internment. Look how blatantly Obama abused the law and created DACA,STEM OPT,H4 etc. Completely unconstitutional which even he admitted. Several court cases were filed and none of them were successful. Now the pendulum has swung. This is not India where you can drag government to court cases and buy time. Cases are decided in matter of months or days if there is no standing. So don't underestimate the power of executive.

Well it does look like that 3 yr extension will be gone and 1 yr. will remain. IV should be ashamed for spreading the panic. But how the hell will USCIS do anything else other than approving the h1b extensions? Another way to slow down the green card approval I guess.

if they go through rule making for reinterpreting AC21, there will be tons of comments opposing it. the proposed rule is marked as other significant so it wont be rushed through. initial draft is coming in Oct 2018. it will take at least an year to implement it. then there will be a flood of lawsuits opposing it. whoever got a previous 3 year extension can challenge this rule. Real purpose of this rule is "Self Deportation" as DHS internal sources mentioned it to different news outlets and this will be used against the rule in the court. there are millions of 3 years extension cases approved based on AC21 in last 17 years. DHS has to explain the court why they want to change the interpretation of AC21 against well established precedence other than anti-immigrant intentions? there is already precedence and if there is confusion between shell or may then court will look into precedence. this will at least delay the rule for few more years. during this whole saga most of us will get our next 3 year extension or at least few one year extensions. after November 2020 there will be a different admin. chances are very high for republican to loose both house and senate majority this November, so guys just relax and enjoy the new year.



Well explaining to the court is pretty easy " Buy American and hire American" and so AG withdrew his consent. Courts usually defers to the Admin on immigration. Even something like Muslim Ban couldn't be blocked so do you think this rule has a chance? There can be lawsuits but the most important thing is the injunction. Those are very hard to get and even if you get one, they can always appeal up to the Supreme Court and no way the SC will go against them.The whole process takes 6-8 months tops. Forget the comments, they don't matter. Not sure if you follow the EAD for I-140 approved rule making but this is exactly how this will go. There will be comments for and against it and they will just say they considered both sides.

Not trying to be pessimistic but this thing can go ugly fast.I hate these immi lawyer's attitude. False assurance and solving problem with a lawsuit. Guess who'll benefit.

The word "may" can be interpreted in different ways. So, there is uncertainty regarding 3 year extensions.
But, what about 1 year extensions. It clearly says"shall". So, does this mean that USCIS will give only 1 year extensions and that cannot be revoked/ changed?
Is this correct?





Even use of "shall" doesn't help. Read here, clearly says SC consider shall as may:

I am convinced that the admin is right and they can safely get rid of the extensions. Immigration is largely left at the discretion of the government and the Congress would never write a law that would force the government to accept immigrants. Imagine if the court interprets shall as must , then the admin can not deny any H1B extension if the green card is pending. But that's not what is happening. They are denying extensions of H1B holders (not specialized enough, low wages etc) even though they have pending green card applications.

Nearly every jurisdiction has held that the word "shall" is confusing because it can also mean "may, will or must." Legal reference books like the Federal Rules of Civil Procedure no longer use the word "shall." Even the Supreme Court ruled that when the word "shall" appears in statutes, it means "may."

This rule will be a Godsend for H1Bs who arrived after 2015. This will clear the backlogs for them to get the visa in less than 6 years. So don't expect a lot of opposition from even Indian immigrants.

I disagree. 70% of the country is in Panic from last year, not just on this issue, but on ALL issues. May be you are not following the issues and evil voices behind this administration, for the past year or so. This administration removed the word "Diversity" from HHS usage. The whiteness of the administration - should have been a clue to you. RAISE act is a hoax. These folks are shooting in their own foot, to maintain the "whiteness" of the nation. Guess what, you can remain a white nation, and die as a white nation - as China and India will push on. To my knowledge China and India have been treating US very kindly. We should stop being kind. And put OUR interests first!

Since you are so frustrated here and confident about India, what is stopping you from making the move? Spouse does not want to live with in laws?



He will not go. Infact if the US govt dangle the green card, he will jump the queue and put on the MAGA hat. Its just the frustration about the possibility of being kicked out from the country he is so desperate to stay.

Calm down dude. Just because they are working for their citizens doesn't mean this is ethnic cleansing. And lets be honest here, there will be minor inconvenience if they send the H1Bs back home. My guess is that the automation will increase and maybe a little offshoring but the net effect will be positive for the country. Their citizens will be hired at higher wages at the expense of the shareholders and the living standards will rise due to middle class making more salary. Don't believe the Kool Aid that the Soros funded liberal media is feeding even though they are on our side.
