Topic: Concurrent Filing - Premium Processing

There are no downsides to premium processing, other than the cost.

EB1C is somewhat easier with an approved L1A.

The most appropriate usage is "Confusing Article". You are right. But Confused Article is not a wrong usage. Both are adjectives.

Generally confusing is used when the situation (or article in this case) is independently not comprehensible enough to make sense. eg:- Raja Sen's rediff reviews on Bollywood movies. They are very confusing and sometimes incoherent although he uses masterful English

Confused is used in case of comparison with another similar situation. Like if a person is talking clearly about situation A but he really meant to talk about situation B, the person is confused.

So if the article is incomprehensible then it is very "confusing" but if the article is talking about situation A but mixes its fact with situation B which is unrelated or loosely related then it is a "confused article."

Trying to teach the troll? I am confusing.

Yes, in the English language you can use confusing and confused interchangeably, I suggest you start heading back to English for immigrants 101.

Just became died on laughing.

Topic: EB1C - Functional Manager-India/Nebraska/140

If they deserve it as much as him, how come they got it before? If everyone deserves it equally, why are there three levels?

Do you know that having a PhD is not sufficient to qualify for EB1(A/B)? You also need to have publications, citations, awards etc. However, there is no education or experience requirement for EB1C.

I work for one of the US financial firms as FTE where we have contractors from CTS, Capgemini etc... Every other day I hear contractors getting GC based on EB1. Feeling like crying :(

Yes, contractors who are supposedly international managers, but work as QA Analysts or Business Analysts, not even programmers.

Always use the I-129 receipt number. The I-539 is irrelevant to a Visa application.

Topic: 401(K) Contribution?

If we enroll in 401k, should we contribute every month or can we skip few months and contribute that amount later by year end to meet total one year contribution.

Most employers allow you to change your contribution at any time (not only at annual open enrollment), however their matching is subject to your contribution.

Topic: 401(K) Contribution?

But contracting life on h1 visa here in usa with very long GC wait is so tough these days. If we face any issues while withdrawing this money from india then it will be so bad. money should be easily withdrawn anywhere from the world if we have to move back to home country before age of 60.

If we withdraw from India by converting to IRA before Age 50 or at 40 then will there be Taxes on that money in usa or india? I know there will be 10% penalty on early withdrawal but what about taxes?

Withdrawal should never be the reason. Retirement savings should be used only in retirement. In extreme emergencies you can always withdraw it irrespective of whether you are in the US or India. If you move to India at 40 and withdraw the money, what will you do with it? Invest it somewhere else? You will just lose taxes and penalties when you do that. Instead leave it in the IRA/401K and withdraw gradually after 60, that way you will not lose anything.

If you are still relying on that I-140 for extensions or PD porting, you should get a lawyer to contact USCIS about it.

Topic: 401(K) Contribution?

If you are contributing in 401k, and move back to India. After retirement, you need to pay US taxes and India taxes on 401k withdrawals. Am I wrong?

You never have to pay double taxes on the same income. Taxes paid to one country will reduce your tax liability in another country.

Topic: 401(K) Contribution?

Hi,

Recently i started working for a startup company and they gave me 401k option after 90 days of start date. My company is matching upto 5% of every paycheck and they gave me John Hancock plan services.
This services has “Asset Allocation Portfolios, Individual Investment options” and I have to mention how much percentage I need to contribute.

Does anyone know how to choose right investment option? Please advise.

Nobody here is a financial planner/advisor. It depends upon your life priorities. Target retirement date funds may be a good idea if you don't want to do much research.

Topic: 401(K) Contribution?

Is it good idea for contracting people on H1 to contribute to 401K without employer matching.
If employer (body shopping employer) is not matching then why would we need to lock some money for future specially when we are un certain about GC and Visa issues and where we stay in future. i think it is good for Fulltime employees who are working on H1 visa for Big IT MNCs or product based companies.

That's not the right thinking. Even without the match, you still have the tax savings to consider. What will you do with the money that you don't contribute? Invest it somewhere? You will have to pay taxes on the returns and compounding effect will be lost. Compounding is very important early in your career. If you are closer to retirement, then it may be ok to keep it outside and invest it elsewhere. (Even then not necessarily).

Trump is going to start issuing piecemeal executive actions for Border wall, H1B and removing country cap for EB.

It will be brought up for discussion very soon. Not in Senate or the House, but in desi pot-luck parties.

There are no limits on rolling over from 401k to IRA. The limits only apply to new contributions.
