I just want to share my timeline after requesting SR.

My wife and I both had pending EAD for > 90 days.
Out of curiosity, I raised her SR on day 93, and mine on day 96. Three days difference.
To my surprise, I got her approval on day 118, and mine on day 121. Also three days difference.

I guess it means SR do affect the way USCIS process cases.
Maybe other couples can also try sequential SR and share the experiences?

Same here. Our 1st biometrics was on June 6th. My wife received notice that EAD was in production on Aug 25th (not me). We both received 2nd biometrics notice on Aug 26th. Don't know what's happening.

Our fingerprint code was 5 (the code was 3 previously). Any ideas?

I thought the only advantage of PP is the speed. Otherwise the passing rate should be the same. So the question would be when will you need your green card? That determines whether you file it PP or not.

Do you mind sharing why VC suggested normal processing instead of PP? Is that related to your credentials? Thanks!

I've raised an online SR for I-765 (c9, I-485 based) on day 91. On day 94 I get an answer saying additional review. Anyone has an idea how long it might take for additional review? Thanks!

"We have received your service request and researched the status of your case. We have had to perform additional review and this has caused a delay in processing time. Your case is currently in line for processing and adjudication. Cases are processed in the order in which they were received."

Scientifically there is no evidence to say that applicants who filed with law firms got approved faster until proven otherwise.

Mine is in TSC, filed with attorney (VC), and had been there for 105 days. Hope we all get approved soon!

I don't think USCIS is talking about you evidence of scholarship or achievement.
Maybe they are talking about copies of diploma, passport, visa?

When making copies of these documents, do not change the size. Do not add anything to it.
And for your published papers, just print the PDFs directly.

Based on the i-485 instruction, you can choose option (a) if:
A. An immigrant visa number is immediately available to you based on an approved immigration petition; or
B. You are filling this application with a completed relative petition, special immigrant juvenile petition, or special immigrant military petition which, if approved, would make an immigrant visa number immediately available to you.

This means you can choose option (a) if you:
A. Have an approved I-140; or
B. Filling your I-140 and I-485 concurrently.

When you have a pending I-140, you cannot choose (a).

1. When you're in J-1, you can file AOS. You will get your EAD/AP. Your status is now J-1/AOS.

2. When you travel abroad, you can re-enter US by your J-1, or by your AP.
a. If you enter by your J-1:
The immigration officer may determine that since you've filed AOS, you showed immigration intent, so that you cannot enter by J-1 (This is a high risk move). You will then have to enter using AP.
b. If you enter by your AP:
Actually using your EAD/AP will invalidate your J-1 status (so now you rely on your pending I-485 only). This will be a problem if eventually your NIW is rejected. You will be out of status immediately when your NIW is rejected. There is no grace period.

3. So I think the general suggestions are to apply for EAD/AP, but do not use EAD/AP unless absolutely necessary.

4. This also applies to F-1 or F-1 OPT holder. For H visas this is not a problem because H visas allow immigration intent.

Use (h), and write "EB2-NIW pending". I actually also wrote my case number in that box.

For (a), it is "petition....that has been approved". You have pending I-140, not approved I-140.

Please read I-140 instruction, page 4, middle part. You still need to file ETA 750B. But don't worry. ETA 750B is quite simple, and will not a require signatures from your previous, present, or potential employers. Although it is still called labor certificate, but it is quite different from the labor certificates other non-NIW people are filling.

For those with other EB-2 category, they have to gone through the PERM process (This is where NIW waives). They are filing Form 9089 instead of ETA 750B.

Actually this RFE is quite easy to respond. Congratulations.

Even if you are EB2-NIW, you still should submit ETA 750B. Actually, you need to submit 2 identical ETA 750B. This is because you are still under the broad EB category.
