Hi all,

My O1 visa got approved in 7 days with PP last week.
My NIW was denied in Jan 2018, my case was one of the pre-Dhanasar cases. I have my APPEAL pending as well which was transferred to AAO today.

I want to file EB1b with the following criteria, do you think I have a good chance?

8 publications (including my MS and PhD theses, I will have at least two more papers in 3 months), 100 citations, 11 reviews, Extensive news coverage of my Nature paper (I am not the first author, 7th out of 15) (NYTimes, Washington Post, UK Daily Mail)
EE Master and PhD
US Full-time R&D job

Hey all,

Just got my O1 approval. It took 7 days. I filed it with PP even though some people told me to do it normal but I just couldn't live with stress all these days. My OPT would have expired in 30 days.

This gives me 3 more years.

BTW, my NIW appeal is still pending.

Does this mean they sent your case to AAO or for review by another officer in USCIS?

I just submitted an abstract to a conference.

Internationally recognized:
My master thesis has been downloaded 1850 times in 63 countries. But only 1 citation for that.

I talked to my attorneys, they said USCIS won't care much about metrics that didn't result in citations.

Also, my Nature paper got extensive news coverage internationally. It got 1 citation after 10 days. Some professor in UK published a news article in Nature about our paper.

Chen says O1 visa has lower standards compared to EB1b.

Filed NIW on Nov 2nd, 2016, got RFE in September 2017, got the denial on Sep 12th, 2018. We'll send the appeal this week.

Exactly, NIW doesn't need a job offer but they still asked for the future work plan. Chen says the officer has made clear errors about my case.
I want to wait and get my PhD then file eb1b but for now, I need an O1 visa to be able to work and stay in the US.

Thank you very much for all the useful information. I had never heard about "bepress" until you mentioned it.
I just found out that my master thesis has been downloaded 1808 times in 63 countries all over the world in less than 2.5 years.

There is 1 military download and 16 government downloads including NIH and NASA.
Unfortunately, I had not used this in my NIW application with Victoria Chen. I had a very good background and they gave me approval or refund service but still, I got denied. I am going to use these data in my appeal. I might have a higher chance of success in the appeal.
I will also use this for my O1 visa and EB1b.

Please let me know if you have any advice. My OPT expires in May and I can not extend it.

I filed on Nov 2, 2016 right before Dhanasar matter.
I got an RFE in Sep 2017 and they questioned my proposed endeavor and mentioned that I didn't have a clear future plan in my application since I was still a PhD student. At the time of RFE, I was working full-time for 5 months then Chen said it's a very easy RFE since I had a job. We replied the RFE and after a month I got the denial.
They questioned pronged 1 and 3. The officer clearly made several errors. One obvious error was my salary. He had not even paid attention to the paychecks we sent. He stated that I get $1300 monthly which was what I got during my PhD, not from my job. Victoria Chen called me herself and was totally shocked about what happened to my case. She said, that specific officer EX0011 has been adjudicating EB1a and NIW at the same time. She said s/he might have confused my case to an EB1a.

USCIS denied my I-140 NIW (and I-485 automatically) on Jan 12, 2018. (We have prepared a very good appeal since the officer has made several clear errors in his/her judgment)

I am about to file O-1 and then after that, I want to file Eb1-B.

My updated credential is:

I will graduate (PhD) this April. Right now I am a full-time employee at a company in the US. (Been working there for 9 months)
7 publications including my MS thesis.
86 citations (74 independent).
7 review papers.
1 recent Nature paper with extensive news coverage like Washington Post and New York Times. ~400,000 views on Youtube. The Nature paper happened on Jan 24th.

95% my citations are for my Master, my master field is slightly different than my PhD's but both at the same school in the US.

Do you guys think I will get O1 PP without RFE?
Victoria Chen doesn't still believe that USCIS denied my case. I was one of those 0.6 % unlucky petitioners.

You think recommenders writing the letter rather than the lawyers is a better choice?

What do you guys think about my profile? Do you think I have a good case for eb1b? My lawyers think so, but sometimes they say those words for marketing purposes.

Master in the US
I will defend my PhD dissertation in a month so graduating in April.
I am working full-time in a very new startup, we are 12 people starting this. I am on OPT now.
7 Papers (3 first author)
90 Citations
7 Reviews for high-impact journals.
Co-author of one Nature paper (published in January 2018). It hit the news this week, it's all over the place. Even Washington Post and NYTimes broadcasted it. The videos posted on youtube has gotten more than 500,000 views in a couple days.


What do you think?
I am planning to file EB1b after I get my PhD this semester.
