Thanks "rest" for writing your useful NIW story.

I agree with some of the points you made, but I don't agree with the "tuition" part. Almost all NIW filers' tuition fees are waived by the school or the supervisor-in-charge pays the tuition. The USCIS might have a problem with student's salary not enough to live a reasonable life in the US but I don't think they care about school tuition. (In my case they argued that my low salary (mistakenly they thought I make $1,300 monthly) is not enough.)

Thanks for the note.

I will prepare all the docs beforehand and refile right after I get my PhD this semester. But in my situation, it doesn't hurt if I appeal. If the appeal is successful, it brings my GC up to speed. If I lose the appeal, my whole new GC process will slow down by 3 months since they don't adjudicate the new I-140 during the appeal.

When did you get an RFE? 2017?

Have you changed your state of residence and employment?

If Yes, then refile is your best option, since you will get it in less time (assuming it goes to Texas). If my case was to be adjudicated in Texas, I'd definitely refile.

Hey,

According to my attorney, I can also apply for EB1b which is for outstanding researchers. Since I am now in industry and not in academia, EB1b might be better in my case (however I have seen several people in industry who got NIW approvals: of course before President Dhanasar).

I will wait until the end of April to get my PhD and see how things go, then I will decide which to file.
Also, O-1 is a less strict version of EB1b although it's just a work visa for 3 years.

Thanks for the advice.

My immigration advisor at my school is working on my pre-OPT problem.
At the same time, I will file O-1. If that gets approved, my problems are solved for 3 years. :)
Chen said O-1 standards are way less strict compared to EB1b. Fingers crossed about that.

The advantage is, it might make the process faster. If the appeal is successful, my I-485 case will become reinstated.
Also, I don't want to re-file now since I won't graduate until April 27th and want to file either EB1b (according to Chen) or NIW after I get my PhD.

Exactly.

The officer in my denial letter has mentioned that I have changed endeavor since my PhD. Chen says the officer has clearly made an error about this since we have proven multiple times in my RFE letter that my job (R&D position) is exactly in the same field of my PhD research. Before even starting my job, in all my PhD papers, I have mentioned the name of my company as the funding source in the acknowledgment section. I don't know how EX 0011 have missed all those documents.

In the appeal, we try to address all the errors the officer has made including my salary, change of endeavor, and national importance of my field.

For how long can we stand this US humiliation? Let's have some pride here.

I don't want to overthink this anymore. I guaranteed a position in Toronto today after a fruitful talk with the manager of a company (250 employees) which found me on LinkedIn. Life in Canada is way less stressful than the US and way better than Iran as well.

This plan will work out for me if my O-1 visa doesn't get approved. I can't tolerate the stress of an NIW and an O-1 denial.

Yes, you're right. I just looked back at Chen's emails in 2016 about OPT. You can get an OPT EAD while I-140 is pending but you cannot extend OPT while I-485 is pending.

This is true if you used your EAD card.
I heard if you don't use your EAD card, it's less likely to get an OPT denial.

As you know I am on pre-completion OPT which was issued on May 5th, 2017 and is valid until May 4th, 2018. I want to graduate this semester on April 26th and apply for post-OPT. My immigration advisor says she is not able to apply for post-opt in the SEVIS system. We need to somehow shorten the date on the pre-opt and apply for post-opt but the system doesn't let them. We've been trying to call them and have meetings with them but they themselves don't know the solution for that issue.

Do you know someone with the same problem?
If I can apply for post-opt I can extend my OPT for 17 more months and that solves all my NIW problems for now.

Sorry if my question's outside the scope of this thread.
