PERM application for CTS (Cognizant) employees

Hello All,

I am a CTS employee, getting ready to have my PERM application submitted to DOL. My 6 years expires in mid-October (no recapture time), leaving me less than 5 months total to get PERM + 140 approved + apply for extension.

Looks like lately the PERM approval is taking around 3 months. HOWEVER, in case of audit, looks like the shortest time of resolution is 6 months. Meaning if I get an audit, I'm toast. So I guess I'll have to do my best to try and make sure my company's immigration team submits all paperwork as correctly as possible, and then just pray.

But I'm worried that CTS along with other big Indian tech firms may be on the INS's hitlist, meaning an audit is inevitable. If there are any other CTS employees on this forum who have applied for PERM recently, would you please share your experiences? If you don't want to discuss publicly, please send me a personal message.

Well, they say that it's on hold for every employee because they are currently going through the "PERM recruitment cycle" (although they've been saying that for the last two months). Last communication I got was that they will resume submissions once the cycle ends in a couple weeks time.

My Perm was filed by cts in 2009 and got 2 years and 2 months to get approval. I got random audit.

But what you have been doing all along and didn't file your perm in last 5+ years?

my case, I was struck with PERM and went audit, I was struck around 5 years, they did perm and got audited they never reply for the audit, it went denied, then they applied again after 1.5 years , again it went audit, mine got struck for audit 2 years. all together 5 years gone..

As I see few of my friends here working in CTS got perm audited and approved. But everybody told me that their application went to audit during regular processing time.

Also those guys told me CTS has very good lawyer firm to answer audit reasons. But this thread just opposite what I hear.

I have to agree from what I've heard from lot of my friends. Their strategy seems to file PERM which results in Audit and wrong category (their favorite seems to EB3 for obvious reasons) to hold on to Employee with no career progression and no salary hikes. I also heard that their Managers and Immigration people in CTS treat the H1B folks pretty badly.

If you are willing to sacrifice 5 - 10 years for your GC with no career progression, you should consider CTS.

This is what we get :

Currently, we are reviewing PERM cases submitted in October 2011. Priority is given to max-out cases only. You will receive an update along with the category once we review your case.

As you may already be aware, Cognizant is currently in the midst of the PERM recruitment cycle, which is mandated by the US Department of Labor. Cognizant cannot file any PERM cases with the DOL until the recruitment phase has been complete. This is impacting all Cognizant associates at this time. We expect to be able to start filing cases again around April 2012. We will ensure that your case is submitted to DOL as soon as we are able to begin submitting cases.

Let's not go by face value and understand what is good and bad about cognizant.

this is true that cognizant's PERM are going for Audit. I am also CTS employee and my PERM was filed in EB3 in early 2009 and got audit and it was approved after 2 years 2 months. Even couple of my other friends got audit. One of My friend did M Tech from IIT-Madras and he was 10+ years experienced and his case was also field in EB3. His case also got audit.
Good thing is that they processed my I-140 in premium and got approved in 2 weeks. PP needed no approval from management.

Consulting companies have limitation. I don't think CTS like companies will like to file in EB2 because there will be lot of queries from DOL/USCIS such as why this job qualifies for advanced degree and I think CTS may not be able to show. Assuming EB2 will be denied they won't do this as they don't want to downgrade their record of approvals.

I joined CTS at X salary in US and they never gave me increment of single penny.

But still CTS is much better than one consulting companies.They have many projects and their relocation policies are very much employee friendly.

I know couple of CTS guys got GC in EB1
They moved to US after 2009 and they filed EB1 last year and got the GC in 1 year.

They have BE+8yrs exp.

I too know 3-4 people who got GC from CTS in 4 moths. People who worked outside India as SA with signifincant number of people reporting to them both in US and outside US, they are filed as Multi national manager, even though they can't speak one line of english properly.
This is loop hole in EB1C system which many companies are availing not just CTS.

you can check how many PERMs have been filed by different employers, COgnizant has filed 46 PERMs so far which is much less as compared to what they did last year.

I checked yesterday regarding perm filing, they told me that they have not yet started yet. The number 46 in myvisajobs website is showing for a long time, those might have been filed in the beginning of this year. Also CTS is processing EB2 for many of its employees. One of my friend got GC in EB2 recently (also one friend in EB1). Though most of the cases are going for audit (including mine :)), I disagree that they do it in purpose.

I also concur that they are not doing this on purpose but for some reason DOL is targeting CTS files PERM's it seems. Whatever be the reason it is impacting the employees only. Immigration Team should come forward and explain there strategy.

Cognizant like companies are just peanut for USCIS. Cognizant will never speak up on this front because they don't want to get their relations damaged with USCIS. If even if a visa of Cognizant gets denied they will never appeal against for due to aforementioned reason.

I am not sure why they are auditing PERMs of Cognizant. It's a good company and they should spare it. Even many H1s of Cognizant are getting RFE.

haha.. good company.. you are just saying it because you work for it. I know that from the aspect of treating employees, CTS is better than infy or TCS. But I have heard horror stories too. But from immigration practices perspective, they are no different from any other indian company. They find loopholes and use it to make money. They exploit the system to the core. Its not just CTS, all big companies and small companies in the IT service industry do that.

On a side note, i know some one from CTS who did not get audited for his second perm app. Got approved in 2 months. His first one got audited and denied, which sounds like very common in CTS.

I agree with you. I too have personally not see any body in Cognizant who didn't get audited in his PERM. My friend joined CTS after doing M.TEch. from IIT Madras and they filed his GC in EB3. He purely deserved EB2.
Getting audited is not good for the reputation of company.

Forget about PERM, I have seen how many h1 of Cognizant got denied because of not having Client Letter.

Looks like time of consulting companies is getting over, it's better to join Full time at Client's location.
