Could people who have gone through the MTR process share their experience please on who how long it took to have their I-290B accepted and how long it usually takes USCIS to reinstate the I-485 to pending status. Thanks in advance for those who can share this information.

my MTR has been pending at TSC since feb 3, 2009. Still no answer. Is there any one who filed a MTR around the same period?
Any input would be greatly appreciated. They say they process cases in order they receive them, so I would like to know if that's true.

Thanks

Did you all file MTR for I-485 on your own or was it prepared by your attorney.

My I140 was revoked in Mid april and my 485 got denied in June. I filed MTR end of June and still waiting to hear my fate.. :-( Anyone applied MTR before June still waiting here? One more question, if you are solely depending on EAD, can you work when your MTR is pending ( & 485 is still denied state) using your EAD. Can anyone share their experience if you got any advice from attorney regarding that. thanks!

Wow Congrats!! Was yours denied due to I140 Revoke? I called USCIS last week and requested the case to be prioritized due to financial difficulties. No news so far. Hope they'll approve soon.

Anyone with a reopened I-485 after MTR?

hi every one please let me know if any one has the same case issue as mine well the USCIS make an error they send me an I 485 Interview in Orlando FL instead of Maryland because my lawyer address in Orlando FL so i called the USCIS and explain to them that i don't live in FL any more and my lawyer send a Fax to the immigration office in Orlando FL said that i will not show up to the interview and its was an error the Orlando immigration office denied my case because i didn't show up !!even if i the Fax letter that my lawyer send them well i make an meeting with an immigration office at info-pass in Baltimore MD i show the officer the prove that it was clearly an error so the officer told me that shes going to request for a Waiver!! and my file need to be transfered from Orlando to Baltimore so they look and wait for the waiver to reopen my case and that could take up to 9 months!! i think i was supposed to applied for Motion To Reopen or Motion To Reconsider (MTR) or Appeal to Administrative Appeals Office (AAO) i didn't file any paper s a waiver or pay any fee is it like that how its works? please let me know if any one knows Thank you

My case has been pending since June. I have no clue why this is taking so long when the issue happened due to the Immigration Officer's mistake in denying without even sending a NOID or RFE. What a pain.

FINALLY MTR APPROVED June 09 - Mar 10 (got an email)! USCIS Sucks. I called in Jan to inquire about the case filed in July last year. It was still pending. I called again this March & they said it is still pending. I got an email yesterday stating that the case was approved in Jan!! Called USCIS today, they claim it is still pending - whatever Obama spent to the NEW IMPROVED site is like money put in the drain. THE STATUS ONLINE AND THE STATUS YOU GET OVER PHONE WITH USCIS MAY NOT BE THE LATEST (OR NOT EVEN CORRECT). Now, I need to wait to get the letter in the mail. Good luck to all those waiting out there.

Hi rom,
Is it legal to stay, when you have applied for MTR, I asked for attorney he says, as soon as I get the copy of H1 transfer denial.
I have to be out of status. and I have to leave the country.
thanks

Status CAN NOT be maintained with a pending I290B and all the ancillary benefits associated with I485 will not be good any more.

I have a pending I290B on an EB1A I140 since Dec 09. Processing time is very long, and uncertain for most of the categories of I140s, shortest being for EB1A which USCIS web site claims to be 7 months. It was 5 months when my petition was running 8 months. One can't get even a proper answer from the USCIS and there seems to be hardly a way to check exactly what is going on. Even the US Senator's office seem to be helpless. After putting a request through the regular USCIS tel #, I got a letter that it is being processed and asked me to contact them if I didn't hear about in the next six months. What a pathetic answer.

@tintin.

Ok guys, first my exp 290 b (MTR) takes around 3-5 months. Once that is approved nothing will change automatically,
your attorney would have to send approval notice or 290b or call uscis to notify that 290b is approved and hence reopen what ever case.

Unless that happens, you case will not move.
HTH,

I have received 485 denial letter from USCIS and it states denial reason for 1-140 revoked and also states do not have appeal option for this denial.

letter did not explains employer revoked 140 or uscis revoked 140 for any misreprasentation of employer.

my question is does all denial letter wording states the same as mine? can any one please share?

Thanks,

my denial notice also said there is no appeal to this decision.

We filed MTR, MTR approved in 3-4 months and then 140 got approved soon after.

Basically,

MTR is : USCIS made a decision without considering something so please consider this information and open the case.

USCIS's stand : per our info this is the decision and hence there is no appeal.

Hope that Helps,
