It is illegal to discriminate against work eligible individuals. Employers CANNOT specify which document(s) they will accept from an employee. I did my interview on 1/9 in Boston and got approved on the spot. Still waiting for approval notice and green card. No updates on websites.
One guy (EB2BostonIran) also from Boston received his green card exactly after three weeks. Also no updates on website for him.

As always it is a waiting game...

Guys: I have received my renewed EAD cards for myself and my wife today after 4 months. I have applied for the renewal on 18th September 2017 and today is exactly 4 months to receive the cards.

The renewal card are valid for 2 years. I do not know whether it is good or bad. Should I wait for 2 more years to receive any RFE for my I485? Or it is normal?

Hey Natan, do you remember the transfer letter that you got from USCIS in Nov 2016. It was written there that the transfer wouldn't change the time line of your case adjudication but you are still here. I am also on the same boat! :) The stuff that you sent in your message from USCIS website has the same weight from my point of view.

My 485, 131 and 765 cases are not trackable online (shows validation error). Got the receipt and FP done. May I know how to make them trackable, if there is a way? Anyone with similar experience?

My 131 and 765 are the same. I called USCIS yesterday and the agent couldn't also see the status, so she transferred me to a L2 officer. The L2 officer said that my case is processing. This strengthen my theory that "My USCIS" is completely separate from the USCIS internal computer system, and even the agents usually don't have access to that portal unless they are at least L2 officers.
Since 485 is more critical than 765 and 131, you might want to call USCIS and ask them if they can resolve that issue. You might want to tell them that you don't want to miss any notices (potential RFEs, etc)

I am currently on L1, my spouse on L2, if I change to H1B, and he does not change to H4, can he still work if his EAD is still valid? anyone got experience?

I did my SR on my I485, and got a reply 12/18/2017, said it is inline to be reviewed. wait for 60 days. Today I contacted my lawyer, asked them to schedule an Info pass, they said since USCIS asked to wait for 60 days, we should wait :(

I talked to the USCIS Level-2 officer today via phone regarding my 485, 765 and 131 not being trackable. They mentioned that it is a technical issue and USCIS is working on fixing it. A friend of mine was advised by the L2 office a few days back, for the same issue, to write an email to the USCIS regarding this. The immigration officer mentioned that this is just a database update issue handled by a different team and not by the immigration officers. I'm still not sure whether I should do that or not but I might do that.

Hi everyone,

My EB2 NIW I140 petition was recently approved and I am considering applying for I485. My question is: Does I140 expire? For instance, would I have the same chance of getting I485 approved if I applied for it in 2 months vs 4 years from now?

I am currently on OPT but I have 7 months to expiration and I could also apply STEM extension, and my employer is applying for O1 for me right now, so basically I am not necessarily in rush for green card.

I know it is tempting but please don't tell me to consult to my attorney :)

If I were you, I would rush for GC NOW! Technically, I-140 does not expire and if you are in the same field, you are good. BUT, here is a big immigration reform coming. This reform will make ALL old I-140s obsolete and you will need to jump into a new line. I don't know your situation, but most academic researchers have ZERO chances under the new system (unless you are not a Nobel Prize winner).

Currently there are no bills proposed for the CR that could affect us. The shutdown is neutral or good for us because it gives Dems more leverage than what they would get if the CR passed (without the Dream Act attached to it). So now the Dems can negotiate a version of DACA plus more enforcement (and maybe cutting of chain migration and DV lottery).

BUT! Sen. Cotton is talking about the total lift of per-country caps (meaning as much as 20 years of waiting for GCs due to Indian bodyshoper companies abusing the system). He is also behind the RAISE Act which can get included into the final version of the bill.

Most other bills proposed by the GOP are okay for NIW. And Dems don't even know we exist...(or any legal EB immigrant, for that matter).

So the shutdown is slightly better for us than no shutdown but the danger of losing everything is still very real and until we get greened there will be no peace of mind.

The processing of I-485 will not be affected if you're past the FBI checks. USCIS is self-funded so it will remain in full operation - meaning dead slow :)
